Regulations on the Research Laboratory "Expert Identification Center"

1. General Provisions
1.1. This provision regulates the appointment, procedure for creation, reorganization, renaming, management and financing of the research laboratory (department) of the IN CONSULTING Limited Liability Company (hereinafter - the Company).
1.2. In its activities, the research laboratory is guided by the following documents:
- The Constitution of Ukraine;
- Labor Code of Ukraine (Labor Code);
- Civil Code of Ukraine;
- The Commercial Code of Ukraine;
- Law of Ukraine "On Remuneration";
- Company Charter;
1.3. This provision applies to full-time and freelance scientific, scientific and pedagogical workers and other workers.
1.4. Issues that are not reflected in the Regulation are resolved by the director in accordance with specific circumstances in accordance with current legislation.
1.5. Information on the directions of scientific activities of the research laboratory, personnel, material and technical and other types of ensuring its functioning is provided on the website of the Society in the form of an information note.
2. Tasks and functions of the research laboratory
2.1. The main tasks of the research laboratory are:
- combining intellectual, financial and material and technical resources when performing scientific research;
- introduction of the results of scientific research into production;
- personnel, material and technical, legal and information support for the implementation of scientific research;
- publication of the results of scientific research (except for cases related to the observance of confidentiality conditions) at conferences, seminars and in scientific publications;
- development of human resources and relevant scientific schools.
2.2. To achieve the set goals, the research laboratory performs the following functions:
- provision of scientific, consulting, expert and other types of services, the direction of which corresponds to the scientific directions of the laboratory, organizations, enterprises, institutions and individuals;
- search for consumers of their products;
- ensuring the commercialization of scientific research results and their introduction into production;
- acquisition and maintenance in proper technical condition of devices, equipment and materials for performing research and consulting and expert work;
- carrying out metrological certification and verification of control and measuring equipment;
- obtaining permits for carrying out certain types of activities;
- collection and generalization of the results of scientific research in the direction of the research laboratory;
- training of scientific and scientific-pedagogical personnel;
- performing other functions in accordance with the objectives and purpose of the laboratory.
3. Organizational structure of the research laboratory
3.1. The structure of a research laboratory and its quantitative composition are determined based on the nature and scope of work, as well as on the functional tasks assigned to it.
3.2. The staff of the research laboratory includes: the head of the laboratory / department, scientific, engineering and other workers of scientific topics. Labor duties of employees are regulated by the corresponding functional duties.
3.3. The structure of a research laboratory can include staff and freelance workers.
3.4. The general management of the scientific work of the research laboratory is carried out by the scientific supervisor or director.
3.5. The operational management of the research laboratory is carried out by the head of the research laboratory.
3.6. In the structure of the research laboratory, specialized groups can be distinguished by areas of work. Leading or senior researchers of the laboratory are in charge of the groups.
3.7. The staffing table of the research laboratory is approved by the director in the prescribed manner.
3.8. The staffing of the research laboratory is carried out within the funds for wages under the concluded grants, business contracts with customers and within the funding of the costs of production development.
4. Workers of the research laboratory
4.1. Research, consulting and expert and other types of work in a research laboratory are performed by full-time or freelance workers, job duties, the rights and responsibilities of which are established by job descriptions and freelance workers.
4.2. Researchers are hired in accordance with the current legislation of Ukraine.
4.3. Employees of the research laboratory are employees of the Company who are subject to the norms established by the Labor Code.
4.4. Research laboratory workers are subject to compulsory social insurance.
4.5. Research laboratory workers participate in all forms of self-government established by the University charter.
4.6. For work in a research laboratory, scientific, scientific-pedagogical and other workers, as well as workers of other institutions, organizations and enterprises with appropriate qualifications, can be involved.
4.7. The forms, systems and the amount of remuneration for the employees of the research laboratory are established in accordance with the current legislation of Ukraine. The sizes and types of allowances, additional payments, bonuses, material assistance and other payments are established in accordance with the order of the director and are charged at the expense and within the limits of funds allocated for labor remuneration.
5. Functions of the scientific supervisor of the research laboratory
5.1. The scientific director of the research laboratory is appointed by order of the director for a period of up to 5 years from among the full-time scientific and scientific-pedagogical workers with experience in scientific and organizational work.
5.2. The duties, rights and responsibilities of employees performing the functions of scientific leaders of a research laboratory are indicated in their job descriptions.
5.3. The supervisor performs the following functions:
- forms strategic directions for the development of the research laboratory for the future;
- determines the main directions of fundamental and applied research carried out by the laboratory based on the problems of the development of science;
- contributes to the timely and high-quality implementation of scientific research, the introduction of their results into production;
- organizes cooperation of the laboratory with other organizations;
- determines the need for advanced training of laboratory scientists;
- determines the need for the laboratory to obtain licenses and other permits for the performance of certain types of activities;
- manages the patent and licensing work of the research laboratory;
- controls the preparation of scientific publications by laboratory workers.
5.4. The scientific supervisor of the laboratory is granted the following rights:
- represent on behalf of the director in other organizations, institutions and enterprises in the areas of activity related to the scientific directions of the laboratory;
- make proposals on the candidacy of the head of the research laboratory;
- to provide proposals on the candidacies of managers and executives in charge of research work;
- coordinate the recruitment and dismissal of laboratory workers.
5.5. The scientific director of the laboratory is responsible for:
- improper performance or non-performance of their duties specified in the job description;
- development of human resources and material and technical base of the research laboratory;
- the effectiveness and scientific level of research work carried out by the research laboratory;
- the development of scientific contacts of the research laboratory for others and institutions, enterprises, organizations;
- the state of innovation and rationalization activities in the research laboratory.
5.6. The scientific director of the laboratory annually reports on the work of the laboratory at the director's meeting, and also at least once every five years - at the Constituent Assembly of the Society.
5.7. The functions of a scientific advisor can be carried out on a voluntary basis or with remuneration. To pay the scientific supervisor, the position of the chief or leading researcher or expert is introduced into the laboratory staffing table. The expenses for the salary of the scientific supervisor are carried out at the expense of the laboratory.
6. Functions of the head of the research laboratory
6.1. The head of the research laboratory is appointed by order of the director of the Society on the recommendation of the scientific director of the research laboratory from among the full-time scientific and scientific-pedagogical workers with experience in scientific and organizational work.
6.2. The position of the head of a research laboratory is filled on the basis of a competitive selection.
6.3. The head of the research laboratory carries out operational management of the activities of the research laboratory.
6.4. The head of the research laboratory is directly subordinate to the director of the Society and in additional subordination to the scientific director of the research laboratory. In the absence of the head of the research laboratory, his functions are performed by the director of the Society.
6.5. All full-time employees and part-time employees of the laboratory are directly subordinate to the head of the research laboratory.
6.6. The head of the research laboratory has the following job responsibilities
- supervises the employees of the research laboratory;
- develops plans and reports from laboratory work;
- organizes the conclusion of contracts for the performance of research work;
- organizes the receipt by the laboratory of licenses and other permits for the performance of certain types of activities;
- organizes monitoring of the state and operation of control and measuring equipment, ensuring its timely submission for periodic inspection;
- organizes the collection and study of scientific and technical information in the areas of scientific activity of the laboratory, analysis and theoretical generalization of scientific data, the results of experiments and observations;
- organizes the storage of reports on research work;
- organizes and controls office work in the research laboratory;
- monitors compliance with the deadlines for the execution of contracts by the heads of research and development work and the deadlines for calculating customers for the services provided;
- organizes the provision of the laboratory with protective equipment and fire-fighting equipment, controls their availability and timeliness of verification;
- controls the provision of confidentiality requirements when performing scientific research
- constantly works to improve the personal qualifications and qualifications of laboratory workers;
- organizes work on the publication of the results of scientific research (except for cases related to the observance of confidentiality conditions) at conferences, seminars and in scientific publications;
- adheres to the requirements of the instruction on labor protection, developed according to the composition of the work that he performs;
- organizes training, briefing and periodic testing of the knowledge of subordinate personnel on labor protection issues;
- develops instructions for labor protection and safe operation of devices.
6.7. The head of the research laboratory has the right to:
- represent a research laboratory on behalf of other organizations, institutions and enterprises;
- distribute responsibilities between laboratory workers;
- to provide proposals on the announcement of competitions for filling vacant positions of scientific workers of the laboratory;
- submit proposals to the director of the Company on incentives and disciplinary actions against laboratory workers;
- submit applications on behalf of the laboratory for equipment and materials;
- in agreement with the scientific supervisor, determine the directions of using the laboratory overhead costs.
6.8. The laboratory manager is responsible for
- improper performance or non-performance of their duties specified in the job description;
- fulfillment of the planned performance indicators of the laboratory;
- safe condition of workplaces, equipment, devices, tools, inventory, etc .;
- targeted and effective use of the overhead costs of the research laboratory;
- the timeliness and validity of the submission by the research laboratory of plans and reports;
- offenses committed in the course of carrying out their activities;
- damage to property.
7. Business planning and reporting
7.1. The activities of the laboratory are carried out in accordance with the annual plan-report of the work of the research laboratory.
7.2. The plan-report of the work of the research laboratory is developed by the head of the research laboratory and approved by the director of the Society.
7.3. The work plan of the research laboratory contains the following sections:
- goals and objectives of the research laboratory per year;
- the staffing table of the research laboratory;
- a research plan broken down by funding sources and the allocation of prospecting research works;
- a plan for preparing projects for receiving grants;
- publishing and information activities;
- creation of objects of intellectual property;
- organizational work;
- a plan to improve the qualifications of employees;
- international connections;
- settlements with customers for services provided;
- plan for the procurement of goods and services;
- calculation of the balance of funds;
- employee vacation plan.
7.4. The work plan of the research laboratory is developed in accordance with the goals and objectives of the laboratory per year, the results achieved in the previous period, the financial capabilities of the research laboratory.
7.5. The plan-report of the laboratory is a trade secret.
7.6. The preparation of the planned part of the plan-report is carried out until December 20 of the previous year.
7.7. According to the results of the activity, the report-report of the work of the research laboratory indicates the reporting data with an analysis of the reasons for deviations in the indicators.
7.8. The reporting part of the plan-report is developed by the head of the research laboratory, agreed by the scientific director of the research laboratory and submitted for approval by the director of the Society until January 31 of the next year.
8. Organization, reorganization and liquidation of the research laboratory
8.1. The creation of a research laboratory is carried out on the basis of the Society. The rationale for creating a research laboratory must contain:
- goals and objectives of creating a research laboratory;
- analysis of scientific and financial results of the Society's activities over the past five years;
- directions of research and expected results for three years;
- list of existing and required scientific equipment.
8.2. The creation, reorganization and liquidation of a research laboratory is carried out on the basis of orders of the director of the Company after approval by the Constituent Assembly of the Company.
9. Material and technical base of the research laboratory
9.1. In order to ensure the achievement of goals and the performance of functions in the research laboratory, premises, equipment and other property of the Company are assigned to the right of operational management.
9.2. The laboratory has the right to use the property allocated to it for operational management solely to achieve the goals of its main activity. Control over the targeted use of property and its preservation is carried out by the Company.
9.3. Responsibility for receiving, storing and dispensing material assets rests with the financially responsible persons of the research laboratory, appointed by order of the Director of the Company.
10. Funds and funding for the activities of the research laboratory
10.1. Research laboratory is not a legal entity and does not have an independent balance
10.2. The research laboratory operates on a self-supporting and self-financing basis.
10.3. The research laboratory is funded by
- at the expense of funds from research and consulting and expert work, grants, funds from the sale of intellectual property objects;
- at the expense of part of the overhead costs deducted from research and consulting and expert work to ensure the activities of the research laboratory;
- at the expense of the Society's funds allocated for the development of a research laboratory;
- at the expense of other sources not prohibited by the legislation of Ukraine.
10.4. The accounting and financial operations of the research laboratory are carried out by the accounting department of the Company.
10.5. Laboratory overhead funds can be used to pay for work, goods and services that cannot be directly attributed to the performance of research work, namely:
- remuneration of the scientific supervisor, head of the research laboratory and other workers performing economic and organizational functions in the laboratory;
- payment for services for obtaining permits;
- going on a business trip in order to conclude contracts for the performance of research work, participation in seminars, conferences, meetings, exhibitions, etc ..;
- acquisition of durable goods;
- acquisition of software and intangible assets;
- purchase of items, materials and inventory to support the activities of the research laboratory;
- advanced training of employees of the research laboratory;
- acquisition of normative and scientific literature;
- equipment verification;
- repair of premises and equipment;
- payment for communication services;
- implementation of innovative and rationalization activities;
- performing exploratory research work in accordance with the approved plan;
- payment for other goods, works and services aimed at developing and expanding the scope of research services.
10.6. The purchase of goods and services for the research laboratory is carried out on the basis of the plan and annex to the procurement plan of the Company.
11. Interaction of the research laboratory with the divisions of the Society and third-party organizations
11.1. In the process of scientific and economic activities, the research laboratory interacts with other structural divisions of the Society and third-party organizations.
11.2. In the course of its activities, a research laboratory may involve machines, devices, equipment, inventory and technical documentation from other divisions of the Company in agreement with their leaders.
11.3. The interaction of the research laboratory with other enterprises, institutions and organizations related to the consumption of financial and material resources is carried out on the basis of business contracts in accordance with the current legislation of Ukraine and the procedure adopted by the Company.
12. The order of entry into force
12.1. This Regulation is put into effect by order of the director after approval at the Constituent Assembly of the Company.
12.2. The position can be supplemented or changed in accordance with the current legislation.
12.3. The Regulation may be canceled after the adoption of the relevant decision by the Constituent Assembly of the Company by order of the Director of the Company.
