Terms offered by our expert organization

Terms that are regulated by legislation

According to clause 1.13 " Инструкции о назначении и проведении судебных экспертиз и экспертных исследований " approved by the Order of the Ministry of Justice of Ukraine No. 53/5 dated 08.10.98, the procedure for establishing the timing of the examination is as follows:

The term for the examination is set depending on the complexity of the study, taking into account the expert load of specialists by the head of the expert institution (or the deputy head or the head of the structural unit) within:

  • 10 calendar days - based on materials with a small number of objects and simple studies;
  • 30 calendar days - based on materials with an average number of objects or average complexity in terms of the nature of the research;
  • 60 calendar days - based on materials with a large number of objects or studies that are complex in nature;
  • more than 60 calendar days - based on materials with a very large number of objects or studies that are complex in nature (studies using forensic equipment (laser, optical, electronic), experimental studies, application of several methods), while the deadline should not exceed 90 calendar days ...

If the examination is especially complex, requires the solution of more than ten issues or the solution of issues requiring several studies, or has more than five volumes of case materials or is complex or requires the involvement of specialists from other institutions (including forensic medicine), enterprises, organizations and other can be performed within the specified time frame, a more reasonable time is established by written agreement with the body (person) that (which) appointed the examination (attracted an expert), after a preliminary examination by the expert of the materials provided.

Preliminary study of materials for simple and medium-complexity research should not exceed five and ten working days, respectively, for complex and especially complex research - fifteen and twenty working days, respectively.

In case of refusal of the body (person) that (which) appointed (a) the examination (attracted an expert), in agreeing the proposed reasonable time for the examination, the case materials are returned with a proposal to appoint an examination to other forensic expert activities, as defined in Article 7 of the Law Of Ukraine "On forensic examination".

In case of non-fulfillment of the expert's requests for the provision of additional materials, non-payment of the cost of the examination in the manner prescribed by the current legislation, failure to ensure access to the research object (obstruction by the parties involved in the case, in the examination of the object), the case materials are returned to the body (person), which ( which) appointed (a) the examination (attracted an expert), indicating the motivated reasons for the impossibility of its conduct.

The examination period begins on the working day following the day the materials are received by the expert institution, and ends on the day the expert's opinion is drawn up (message about the impossibility of giving an opinion). If the end of the established term for the examination falls on a non-working day, then the next working day shall be considered the day of the end of the term.

The term of the examination does not include the term for fulfilling the expert's requests, eliminating the shortcomings made by the body (person) that (which) appointed the examination (attracted the expert).
