Consumer expertise is a comprehensive analysis of goods or services. Experts investigate:
Discrepancies with official regulations or documentation developed by the manufacturer are recorded in writing, with an explanation of the reasons for the discrepancy. The expert opinion contains references to the normative legal acts, the violation of which was revealed by the experts.
If the quality of the product does not correspond to the declared one, the consumer suffers obvious damage. Situations that pose a danger to human life and health require special attention. The consumer has the right to receive a quality item or service for his money, and he is protected by law.
If defects are found in the purchased product, but the buyer cannot independently replace it with high-quality and safe, or receive the money paid back, an independent consumer expertise helps to defend his rights.
What should the consumer do if the product does not satisfy? The first step is to try to solve the problem on the spot. Conscientious sellers and suppliers are willing to accommodate. A low-quality or dangerous product is replaced, repaired free of charge, money is returned, and a discount is made. If the consumer is not satisfied with the proposed options, or they completely refuse to cooperate with him, it's time to turn to experts and prove his case.
Each industry has its own rules and characteristics. Therefore, our employees, who are the best trained in a particular field of activity, act as experts. We use the following documents in our work: the Law of Ukraine "On Protection of Consumer Rights", and the state-registered standard "Consumer Expertise of Products". Within the framework of the latter, the procedure for conducting and formalizing the results of the examination is indicated. The requirements for the specialists conducting it are listed. The procedure for filing an application, documents and products purchased by a consumer for sending for research is described.
The standard is included in the program of adaptation of Ukrainian regulations to EU legislation. Consumers can count on European level protection.
The result of an independent consumer examination is an expert conclusion with detailed justification. This is a legally relevant document that can be used in court. Having it in hand, the consumer makes legal claims to the supplier or manufacturer. As a result of the proceedings, damages are reimbursed, including moral damage. The costs of the trial are borne by the culprit.
An expert can be ordered by an individual or a legal entity. Any capable citizen or organization affected by the actions of unscrupulous suppliers.
