Retail trade is the activity of selling goods to citizens and other end consumers for their individual non-commercial use, regardless of the types of settlements, including for bottling in cafes, restaurants, bars, or other business entities of public catering.
Business entities of all forms of ownership, including manufacturers of products, who intend to engage in entrepreneurial activities in the retail trade of tobacco and alcoholic products, are obliged to obtain a license for the right to conduct this type of activity.
For violation of the legislation on retail trade in ethyl alcohol, tobacco products and alcoholic beverages, cognac and fruit, without a license (patents) or in violation of trade rules, penalties are imposed in the form of fines - 200.00% of the price of the consignment received, but not less than 100 n. m. d.
To the subject of licensing, when registering a license for the right to conduct retail trade in tobacco and alcoholic products, the legislation imposes a number of requirements, namely:
- place of trade;
- a room that must be equipped with electronic cash registers;
- retail sale of tobacco products or alcoholic beverages from hands and in premises unsuitable for this, on the territory of preschool, educational and medical institutions and adjacent territories, hostels, places of sports competitions and adjacent territories and in other places established by settlement, village, city councils is prohibited ...
By the time the documents are submitted to the licensing authority, the business entity is obliged to pay a monetary payment for the right to carry out retail trade in tobacco and alcoholic products.
The annual fee for retail trade in tobacco products is UAH 2,000.00. for each place of trade.
The annual fee for retail trade in alcoholic beverages other than peri and cider (no added alcohol) is UAH 8,000.00. for each separate, further specified in the license, electronic cash register or account book of expenditure transactions located directly at the place of trade.
The payment for licenses for the right to retail trade in tobacco products and alcoholic beverages is charged in equal parts, on a quarterly basis and is credited, in accordance with the current legislation, to the state budget.
